{"id":3884,"date":"2018-09-04T00:00:00","date_gmt":"2018-09-04T06:00:00","guid":{"rendered":"https:\/\/universalaccountingschool.com\/rtrp-court-case-updates\/"},"modified":"2025-03-12T01:44:40","modified_gmt":"2025-03-12T07:44:40","slug":"rtrp-court-case-updates","status":"publish","type":"post","link":"https:\/\/universalaccountingschool.com\/rtrp-court-case-updates\/","title":{"rendered":"RTRP Court Case Updates"},"content":{"rendered":"<div id=\"post-1227\" class=\"post\">\n<p style=\"text-align: justify;\"><span style=\"font-size: 13px;\">We\u2019ve been updating our readers on the status of the RTRP court case for the past few months.\u00a0 <\/span>Our last update ran in April<span style=\"font-size: 13px;\">.\u00a0 Here is what\u2019s happened since:<\/span><\/p>\n<p style=\"padding-left: 30px; text-align: justify;\"><strong>May 16, 2013.<\/strong>\u00a0 The IRS released a statement regarding the refunds for canceled RTRP scheduled tests:<\/p>\n<p style=\"padding-left: 60px; text-align: justify;\">Fee amounts collected for scheduled registered tax return preparer test appointments canceled due to the court-ordered injunction are being refunded. Additionally, fees collected from return preparers who tested on or after January 18, 2013, the date the test was enjoined, are also being refunded. No additional refund or reimbursement requests related to registered tax return preparer regulation are being provided or considered at this time. E-mail notifications will be provided to those receiving refunds to explain the process. No action is necessary to receive the refund. Credit for the test fee will automatically be made to the account used to pay the fee. It is anticipated that all refunds will be processed by July 19, 2013.<\/p>\n<p style=\"padding-left: 30px; text-align: justify;\"><strong>May 17, 2013.<\/strong>\u00a0 <a href=\"http:\/\/www.natptax.com\/TaxKnowledgeCenter\/RTRPExam\/Documents\/plaintiff-appellees-brief.pdf\">The Brief of Plaintiffs-Appellees<\/a> was filed in the <em>Loving<\/em> case at the U.S. Court of Appeals.\u00a0 The brief contends that Judge James E. Boasberg misinterpreted 31 U.S.C. \u00a7 330.\u00a0 The brief reads: \u201cAs the district court noted, preparing a tax return is nothing like \u201cpresenting\u201d a \u201ccase.\u201d A tax return is informational and does not contain advocacy or argument. It is simply a (mandatory) self-assessment of one\u2019s tax liability that reports financial information, such as income, tax payments, and charitable contributions, as well as any relevant life events, such as a change in marital status, a change of job, or children, and shows the calculations made to determine one\u2019s tax liability.\u201d<\/p>\n<p style=\"padding-left: 30px; text-align: justify;\"><strong>May 24, 2013<\/strong>.\u00a0 The Tax Foundation and seven tax preparers, both enrolled and unenrolled agents and CPAs, filed an <a href=\"http:\/\/www.natptax.com\/TaxKnowledgeCenter\/RTRPExam\/Documents\/Amici-Curiae-Support-Appellees.pdf\">Amici Curiae in Support of Plaintiffs-Appellees<\/a>. The brief argues three points:<\/p>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li><span style=\"font-size: 13px;\">The amici curiae filed by five former Commissioners is incorrect in asserting that preparing a return is not \u201cpresenting a case\u201d but rather a presentation of conclusions based on information included in the return.<\/span><\/li>\n<li><span style=\"font-size: 13px;\">The RTRP regulations violate the arbitrary and capricious standard.<\/span><\/li>\n<li><span style=\"font-size: 13px;\">The RTRP regulations violate the notice and comments requirements.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"padding-left: 30px; text-align: justify;\"><strong>June 5, 2013.<\/strong>\u00a0 The IRS filed the <a href=\"http:\/\/www.natptax.com\/TaxKnowledgeCenter\/RTRPExam\/Documents\/IRS-Reply-Brief.pdf\">Reply Brief for the Appellants<\/a> which argues that \u201cpractice of representatives of persons before the Treasury Department\u201d in \u00a7330(a)(1) is ambiguous and can be applied to tax preparers now even though the IRS administration chose not to apply it in the past.<\/p>\n<p style=\"padding-left: 30px; text-align: justify;\"><strong>June 28, 2013<\/strong>.\u00a0 As noted in the NATP update, \u201cThe United States Court of Appeals for the District of Columbia Circuit Court will hear oral arguments in the\u00a0<em>Loving v. IRS<\/em><em>\u00a0<\/em>case on September 24, 2013 at 9:30 AM ET. The oral argument will be before Circuit Judge Kavanaugh, and Senior Circuit Judges Williams and Sentelle. Each party will have the opportunity to present their arguments before the judges.
